Acceptable Use Policy
The short version
- Make what you want within the law and these rules. Fiction, drama, action, horror, ads and client work are all welcome.
- Using a real person's face or voice needs their consent. Public figures and anyone under 18 are blocked.
- Zero tolerance for sexual content involving minors, and for intimate images of real people made without consent.
- Don't deceive people: no impersonation, scams, fake reviews or misleading election content. Label AI content where the law or the platform requires it.
- Don't remove content credentials or watermarks.
- Don't attack the Service or get around its limits, filters or spend caps.
- If we block something, we tell you which rule it hit and why. A person reviews every appeal.
- Report problems with the report button or the takedown form. Where action is warranted, we act within 24 hours.
1. Scope
This policy is part of our Terms of Service. It covers everything you upload, prompt, generate, publish or share with Nineplane, through the web, Planes MCP or the API, and anything an AI assistant or app does with your account. If you build an app on our API, its users must follow these rules too.
2. Real people: faces and voices
2.1 Consent comes first. You need a person's consent to use their face or voice in any of these ways:
- a subject or face swap;
- motion transfer onto their photo;
- a trained character;
- a cloned voice;
- a talking avatar, lipsync or dub in their voice; or
- any image or video made to look or sound like them.
2.2 Proof of consent. We may require proof before a job runs, or before you export or publish the result:
- Your own face or voice: a short live capture in the studio, such as a video selfie or reading a random phrase aloud.
- Someone else's: a release signed by that person, on our form or one that covers the same points. It must cover the use of their face or voice with AI tools and our processing of their face and voice data.
The Privacy Policy explains how we handle verification data.
2.3 Blocked: public figures and minors. You can't use the face or voice of a public figure (for example a politician, celebrity, athlete or well-known creator), or of anyone who is or appears to be under 18, in any of the ways listed in 2.1, even with consent. This includes lookalikes and soundalikes meant to imitate them.
2.4 People who have died. If the person has died, consent must come from whoever controls their estate or likeness rights. Public figures stay blocked.
2.5 Staying within the consent. Use a likeness only in the ways the person agreed to. A person can withdraw consent by contacting us or, for their own likeness, in settings. We then stop new jobs that use it and delete the related character or voice. Outputs already made under a valid release are governed by that release and the law, and our takedown process (section 14) still applies to any that cause harm.
2.6 Editing footage of real people. You don't need extra verification to edit footage you have the right to use, for example splitting it into layers, regrading it or replacing a background, as long as you don't change who someone is or what they say, or make them appear to do something they didn't do.
2.7 Synthetic people. You can create people who don't exist. Don't present a synthetic person as a real customer, expert or witness, and label synthetic presenters as AI-generated where the law or the platform requires it.
3. Child safety
We have zero tolerance for child sexual exploitation. You must not upload, generate, request or share:
- sexual or sexualized content involving anyone who is or appears to be under 18, whether real, drawn, animated or AI-generated; or
- content that grooms or sexualizes children, or encourages harm to them.
We scan every input and output with hash matching and classifiers. When we find child sexual abuse material, we block it, close the account, preserve the evidence and report it to the National Center for Missing & Exploited Children (NCMEC), as US law requires. NCMEC may share reports with law enforcement anywhere in the world.
Non-sexual depictions of fictional children, such as a generated family scene, are allowed. Real children's faces and voices are blocked under section 2.3.
4. Sexual content and intimate images
4.1 Intimate images without consent. Never create or share sexual or intimate images or video of a real person without their consent. This includes "undressing" edits, swapping a face onto sexual content, and sexualized edits of ordinary photos. We remove this content, block it from being uploaded again, and close the accounts that make or share it. We may use hash lists such as StopNCII.org to stop known images from being uploaded.
4.2 Sexually explicit content. Sexually explicit content isn't allowed, including content showing fictional adults.
4.3 Not sexual in itself. Swimwear, fitness, dance, breastfeeding, medical and educational images are not sexual content in themselves. If our filters block one of them by mistake, appeal, and a person will review it.
5. Deception and fraud
Don't use Nineplane to:
- impersonate a real person, business or official, or falsely suggest that they endorse something;
- defraud anyone, for example with fake investment pitches, romance scams or fake emergency calls in someone's voice;
- create fake reviews or testimonials, or present synthetic people as real customers;
- mislead people about when, where or how to vote, or about election results;
- make political ads with AI-generated or altered people or voices without the disclosures the law requires; or
- make fake documents, news reports or evidence, such as IDs, receipts or broadcasts, meant to be taken as real.
Labeling. If you publish realistic AI-generated or AI-altered content showing people, places or events, label it as AI-made wherever the law or the platform requires it, for example under the EU AI Act's rules on deepfakes or a platform's AI-content labels. Our content credentials help, but they don't replace a visible label where one is required.
6. Harm to people
Don't create or share content that:
- threatens, harasses, bullies or doxxes anyone;
- attacks people for their race, ethnicity, national origin, caste, religion, disability, sex, gender identity, sexual orientation, age or serious illness;
- praises, supports or recruits for terrorist or violent extremist groups, or glorifies real attacks;
- shows real graphic violence to shock or degrade, or encourages violence;
- promotes or gives instructions for suicide, self-harm or eating disorders; or
- exposes someone's private information, or uses images of a person recorded in a private setting without their knowledge.
Fictional violence of the kind found in film, TV and games is allowed, as long as it doesn't target real people or real groups.
7. Illegal and dangerous activity
Don't use Nineplane to:
- make content that is illegal where you are or where you publish it;
- promote or sell illegal drugs, weapons or other regulated goods unlawfully;
- give real instructions for making weapons capable of mass harm, including chemical, biological, radiological, nuclear or explosive weapons; or
- spread malware, phishing pages or spam.
8. Other people's work
- Your inputs. Use material you own, have licensed, or are allowed to use by law, for example under fair use.
- References and driving videos. You can use someone else's video as a reference so Splice or Recast can follow its timing, cuts, motion or camera. Copying protected parts of it, such as its footage, music, characters or artwork, into your output needs permission.
- Brands. Don't use others' trademarks or logos in a way that suggests they made or endorse your work, and don't make counterfeit products or ads for them.
- Copyright complaints go through our Copyright and DMCA Policy.
9. Content credentials and watermarks
Don't remove, alter, crop out, obscure or forge the content credentials (C2PA) or watermarks on outputs, and don't use Nineplane to strip them from other content. Don't present an output as unedited camera footage. Normal editing in other software that happens to drop metadata isn't a breach; deliberately removing or hiding provenance is.
10. Using the Service fairly
Don't:
- probe, scan or test the security of the Service without our written permission, or try to access other people's data;
- get around moderation, rate limits, spend caps or plan limits, including by rewording a blocked prompt again and again to slip past it;
- create several accounts to collect free credits, or abuse referrals;
- use stolen payment details, or dispute valid charges for jobs that ran as quoted;
- scrape the Service, or access it by automation other than Planes MCP and the API; or
- share or sell account access, or sell credits.
AI assistants, agents and apps acting for you are held to the same rules.
11. Publishing, Recipes and promotion
- Public posts and Recipes are checked before they appear and must follow this policy.
- Keep the credit line on any Recipe you remix.
- Disclose paid promotion. If we pay you, give you credits or free access, or you earn commission for promoting Nineplane, say so clearly in every post, for example "#ad" or "Paid partnership with Nineplane".
- Show real results. Don't present edited, retouched or stock footage as raw Nineplane output, and don't claim results the tools didn't produce.
12. How we enforce these rules
12.1 How we find problems. Automated scanning of prompts, uploads, video frames and outputs; reports from users and others; and review by trained staff of what those flag.
12.2 What we tell you. When we block a job or restrict content, we tell you:
- what we blocked or restricted;
- which rule it broke, and the facts that led to the decision;
- whether the decision was automated; and
- how to appeal.
Where we can, we suggest a change that would pass. You aren't charged for anything blocked at input.
12.3 What we do. We match the action to the harm. Depending on how serious the problem is, we may block a job, remove content or make it private, turn off public sharing or a feature, warn you, suspend the account, or close it. For most rules we follow this ladder:
- First confirmed violation: a warning, and the content is blocked or removed.
- Second within 12 months: the feature involved is restricted for 7 days.
- Third within 12 months: the account is suspended while a person decides whether to close it.
A violation is confirmed once any appeal is finished. Violations older than 12 months no longer count. A blocked prompt on its own is not a violation, but deliberately working around a block is.
12.4 Immediate closure. We close accounts without warning for:
- child sexual abuse material;
- intimate images of a real person without consent;
- credible threats of violence;
- using a real person's face or voice to defraud anyone; and
- deliberate attacks on our systems.
12.5 Authorities. We report child sexual abuse material to NCMEC, and we contact law enforcement when someone's life or safety is at imminent risk.
13. Appeals
- Appeal from the notice in the studio, or by emailing [SAFETY EMAIL], within 6 months of the decision.
- A trained person who wasn't involved in the original decision reviews it, and we send you the result and the reason within 7 days.
- If we got it wrong, we restore the content, clear the violation and refund any credits the decision cost you.
- If you believe our child-safety systems flagged something by mistake, you can ask a person to review the account decision. We can't restore material that is child sexual abuse material.
14. Reporting content
14.1 How to report. Use the report button on any public item or shared result, the takedown form at /report, or email [SAFETY EMAIL]. You don't need an account.
14.2 What helps us act. The link or location of the content, what is wrong, the rule or right involved, and how to reach you. You can report child sexual abuse material without giving your name.
14.3 What happens. We confirm that we received your report and review it. Where action is warranted, we remove or restrict the content within 24 hours of the report, everywhere it appears on Nineplane. We tell you what we decided and why. We also tell the person who posted it, and how to appeal, unless that would put someone at risk.
14.4 Intimate images. If intimate images of you, real or AI-made, were shared without your consent, report them with:
- your signature (typing your full name is enough);
- a link or other information we can use to find them;
- a short statement that you believe they were shared without your consent; and
- how to contact you.
Someone authorized to act for you can report for you. We remove the images within 24 hours and make reasonable efforts to find and remove copies on Nineplane. We act on incomplete reports too, and follow up if we need more.
14.5 Your face or voice. If someone used your face or voice without your consent, report it. If we have no record of your consent, we take the content down within 24 hours and block further use of your likeness. If we hold a release in your name, a person reviews it with you.
14.6 Child sexual abuse material. Report it with the report button or to [SAFETY EMAIL]. Don't download it, copy it or send it to us. You can also report directly to NCMEC's CyberTipline (CyberTipline.org) or, outside the US, to a national hotline listed by INHOPE (inhope.org).
14.7 Copyright. Use our Copyright and DMCA Policy.
14.8 Misuse of reporting. If someone keeps sending reports that are clearly unfounded, we warn them first, and then may pause handling their reports for a set time.
15. Changes and contact
We update this policy as our tools and the law change. Material changes follow the notice rules in the Terms of Service. Questions about this policy: [SAFETY EMAIL].
