Copyright and DMCA Policy
The short version
- We respect copyright, and we expect people who use Nineplane to do the same.
- To report infringement, send a notice with the six items in section 3 to our designated agent or through the takedown form.
- We remove or disable the material within 24 hours of a complete notice, and tell the person who posted it.
- If your content was removed by mistake, you can send a counter-notice. Unless the claimant goes to court, we restore the material 10 to 14 business days after we receive it.
- Three strikes within 12 months closes an account.
- Complaints that aren't about copyright, such as likeness, privacy or trademarks, go through the takedown form instead.
1. Scope
This policy is part of our Terms of Service. It covers everything stored on or shared through Nineplane: uploads, outputs, public posts, share links, profiles and Recipes. It follows the US Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We accept notices from copyright owners anywhere in the world.
2. Before you send a notice
- Make sure you own the copyright, or are authorized to act for the owner.
- Consider whether the use may be fair use or otherwise allowed by law. The law expects you to consider this before you send a notice.
- Copyright doesn't protect a style, a technique, an idea or a general look.
- If your complaint is about a person's face or voice, privacy, a trademark, or harmful content, use the takedown form at /report instead. Our Acceptable Use Policy covers those.
- Knowingly misrepresenting that material infringes can make you liable for damages, including our costs and legal fees, under 17 U.S.C. § 512(f).
3. How to send a copyright notice
Send your notice to our designated agent (section 8), or use the copyright option in the takedown form at /report. It must include:
- your physical or electronic signature (typing your full name is enough);
- identification of the copyrighted work you say is infringed or, if one notice covers several works, a representative list of them;
- identification of the material you say infringes, with enough information for us to find it, ideally the URL of each item;
- your name, address, telephone number and email address;
- a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law; and
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or are authorized to act for the owner.
If your notice is missing something, we contact you to help complete it.
4. What happens after a notice
- Within 24 hours of receiving a complete notice, we remove or disable access to the material everywhere it appears on Nineplane, including public pages and share links.
- We tell the person who posted it and send them a copy of the notice. The copy includes your name and the details of your claim; we remove your street address and phone number.
- We record a strike against their account (section 6).
- We don't decide who is right in a copyright dispute. We follow this process, and courts decide disputes. We can still act separately under our Acceptable Use Policy if the material breaks it in other ways.
5. Counter-notices
If you believe material was removed by mistake or because it was misidentified, you can send a counter-notice to our designated agent, or through the link in our removal notice. It must include:
- your physical or electronic signature;
- identification of the material that was removed and where it appeared before it was removed;
- a statement, under penalty of perjury, that you believe in good faith that the material was removed or disabled as a result of mistake or misidentification; and
- your name, address and telephone number; a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located or, if your address is outside the United States, any judicial district in which Nineplane may be found; and a statement that you will accept service of process from the person who sent the notice, or their agent.
What happens next:
- We send a copy of your counter-notice, including your contact details, to the person who sent the original notice. The law requires this so they can decide whether to go to court.
- Unless they tell us, before we restore the material, that they have filed a court action seeking to stop the alleged infringement, we restore it 10 to 14 business days after we received your counter-notice.
- When material is restored this way, the strike is removed.
- Knowingly misrepresenting that material was removed by mistake can make you liable for damages under 17 U.S.C. § 512(f).
6. Repeat infringers
We close the accounts of repeat infringers:
- Each valid notice that leads to removal is one strike, however many items it lists.
- A strike expires 12 months after it is recorded.
- A strike is removed if the material is restored after a counter-notice, or if the notice is withdrawn or found invalid.
- An account with three active strikes is closed, and its owner may not open a new one.
- In a team workspace, strikes count against the person who uploaded or published the material. If a workspace keeps receiving strikes through different members, we may turn off its public sharing.
- We may close an account after fewer strikes if it is clearly dedicated to infringement, or if a court has found that its user infringed.
Section 9.4 of the Terms of Service explains what happens to credits and content when we close an account.
7. Other complaints
- Not about copyright. Likeness, privacy, intimate images, trademarks and harmful content go to /report or [SAFETY EMAIL], under our Acceptable Use Policy.
- From outside the US. We handle copyright notices from anywhere through this process. In the EU, you can also send a notice under the Digital Services Act through /report.
- Nineplane's own content. If you think something we published infringes your copyright, use this process too.
8. Designated agent
Our designated agent to receive notices of claimed infringement under 17 U.S.C. § 512(c)(2) is:
- Name: [DMCA AGENT NAME], Copyright Agent
- Company: [LEGAL ENTITY NAME]
- Address: [ADDRESS]
- Email: [DMCA AGENT EMAIL]
- Phone: [DMCA AGENT PHONE]
This designation is registered in the US Copyright Office's DMCA Designated Agent Directory, registration number [DMCA REGISTRATION NUMBER].
This contact is only for copyright notices and counter-notices. For anything else, use [CONTACT EMAIL] or /report, so your message reaches the right team quickly.
9. Changes
We may update this policy. Material changes follow the notice rules in the Terms of Service.
